Antitrust
Our Head of Complex Litigation has prosecuted antitrust and unfair trade claims relating, but not limited to, pharmaceutical drugs, financial markets, technology, telecommunication industries, and transportation industries.
Federal and state antitrust laws are primarily concerned with protecting the economy and to promote competition between businesses by preventing (a) collusion among "competitors" that might result in restraints on competition in a given industry or market, and (b) anticompetitive conduct by a particular entity who holds substantial power in a given industry or market.
Claims for damages under the federal antitrust laws are ordinarily limited to businesses and individuals that purchased goods or services directly from the person or company that violates the antitrust laws. Since most goods pass through various levels of distribution (i.e., wholesalers and retailers) before reaching the end-user consumer, many states have created antitrust laws to protect these types of businesses and individuals.
